Results of Administrative Reconsideration to Be Publicized Online in Zhengzhou, Henan Province and Nonfeasance of Government Officials to Be Compulsorily Implemented

  To complain about officials to officials, common people are afraid of the phenomenon of bureaucrats shielding one another. Nowadays, people in Zhengzhou City of Henan Province do not have such worries.

  “Publicity can eliminate people’s reasonable suspicions to the utmost.” According to related head of the Legal Affairs Bureau of Zhengzhou Municipal Government of Henan Province, the Interim Regulations of Zhengzhou City on Handling Administrative Reconsideration Cases in a Centralized Way, which became effective on January 1,2009, stipulates that the decision of administrative reconsideration of common people accusing government officials, except for those involving in state secrets, commercial secrets and individual secrets, should be publicized on the Internet so that people can assess the officials and judges.

  “After administrative reconsideration departments conclude decisions on administrative reconsideration cases, they should inform the decisions to related parties; meanwhile, they should, under the circumstance that no state, commercial and individual secrets are involved, also publicize the decisions on the legal affairs website of administrative reconsideration departments so as to be supervised by the people.” According to the head of Legal Affairs Bureau of Zhengzhou Municipal Government, in case when the common people win the accusation against government officials, and the officials refuse to appeal or implement the decision, the decisions will be implemented compulsorily.

  The detailed circumstances include: Refusing to support administrative reconsideration offices in accepting and handling cases of administrative reconsideration; refusing to implement the administrative reconsideration decisions made by administrative reconsideration offices of the upper levels; accepting applications of administrative reconsideration without approval from the upper authorities; making administrative reconsideration decisions without approvals from the upper authorities; not going through the procedures of responding to charges. Other activities that should be investigated, the Administrative Reconsideration Office of the municipal level should instruct supervision departments to investigate related personnel according to law.
